Terms and Conditions of Use
License
You have permission to use the free learning materials hosted on this site for personal and non-commercial educational use only. Premium content, where applicable, is available to registered subscribers under the same non-commercial terms.
This is the grant of a license, not a transfer of title. Under this license you may not:
- Modify or copy the materials
- Use the materials for any commercial purpose or public commercial display
- Attempt to decompile or reverse engineer any software contained on the ESLeCollege website
- Remove any copyright or other proprietary notations from the materials
- Transfer the materials to another person or mirror the materials on any other server
This license shall automatically terminate if you violate any of these restrictions and may be terminated by ESLeCollege at any time. Upon termination you must destroy any downloaded materials in your possession whether in electronic or printed format.
Personal Use
Personal use means either using materials hosted on our website for your own use, or for use with students that you yourself teach.
Non-Commercial Use
Non-commercial use means that you are not permitted to make money from using our materials in any way, or gain commercial or personal advantage from using them. Prohibited uses include offering them (or modified versions of them) for sale, or embedding our content within a frame on another website which hosts ads or charges people to view content.
Permitted Use of Handouts and Worksheets
Our handouts and worksheets may be:
- Downloaded and stored offline for personal, educational use, provided that they are complete copies and that any copyright and authorship notices, licences, acknowledgements and hyperlinks within the pages are retained
- Printed out and used in the classroom provided that any copyright and authorship notices, licences, acknowledgements and hyperlinks within the pages are retained
Offline storage for personal, educational use means they may be stored on computer equipment belonging to you.
Prohibited Use
- You may not claim authorship, sell, publish, or distribute our materials
- You may not store copies of any learning materials (or modified versions of them) on blogs, wikis, school servers, file sharing sites, social media sites, or anywhere else online, or distribute them by electronic means in any way
- Demanding payment to view, download or otherwise use our materials by putting them behind a paywall is prohibited
Please consider linking to our pages instead if you think people will find our materials useful. We reserve the right to charge for any commercial or prohibited use of our materials that breaches our copyright and/or these terms and conditions, at our discretion.
User Accounts
Registration
To access certain features of the Service — including lesson progress tracking, vocabulary games progress, and the student dashboard — you must register for an account. By registering you confirm that the information you provide is accurate and that you are authorised to use the email address you supply.
Account security
You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorised use of your account.
Age and eligibility Updated
We ask for each student's date of birth at registration. How an account is handled depends on the student's age:
- Students aged 13 or over may register and give consent for themselves.
- Students under 13 may register, but the account is held inactive until a parent or guardian provides consent. We request this by email; the account is activated only once consent is given.
- Students registered through a school may be covered by the school's authorisation and the consent it has obtained.
By registering you confirm that the details you provide, including your date of birth, are accurate. Full details of how we handle students of different ages are set out in our Privacy Policy.
Account termination
ESLeCollege reserves the right to suspend or permanently delete any account that violates these Terms, engages in misuse of the platform, or provides false registration information. You may delete your own account at any time using the "Delete my account" option in your dashboard. Deletion permanently removes all associated data.
Unverified and unconfirmed accounts
Accounts where the registration email has not been confirmed within 30 days will be automatically deleted. Accounts awaiting guardian consent that is never provided are treated as inactive and may be removed.
Submitted Work and AI-Assisted Marking New
Some account types let students submit work to be marked — written tasks such as essays and short answers, and speaking tasks recorded as audio. To provide marking and feedback, this work may be processed by third-party artificial-intelligence services, which may process it on servers outside Thailand, as described in our Privacy Policy.
Ownership of your work
You retain ownership of any work you submit. By submitting work, you grant ESLeCollege a non-exclusive licence to store and process it — including through the third-party services described above — solely to provide marking, feedback, and progress tracking. ESLeCollege does not claim ownership of your work and does not use it for unrelated purposes such as advertising.
Your responsibilities
You must not submit content that is unlawful, infringes the rights of others, or is harmful or offensive. Marking and feedback are provided to support learning and are not guaranteed to be free from error; they do not replace assessment or grading by a qualified teacher or examiner.
Subscriptions
Some features of ESLeCollege are available on a subscription basis. Full subscription terms — including pricing, billing cycles, cancellation, and refund policy — will be published here when paid plans are introduced. Use of any paid features, including AI-assisted marking, is subject to those additional terms and to Section 07 above.
Creative Commons Licences
You agree to abide by any Creative Commons licences that apply to content published on our sites, and to acknowledge and attribute any sources in the manner stipulated within such licences.
Disclaimer
The materials on ESLeCollege's website are provided on an 'as is' basis. ESLeCollege makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
ESLeCollege does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
Limitations of Liability
In no event shall ESLeCollege or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on ESLeCollege's website, even if ESLeCollege or an authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Accuracy of Materials
The materials appearing on ESLeCollege's website could include technical, typographical, or photographic errors. ESLeCollege does not warrant that any of the materials on its website are accurate, complete, or current. ESLeCollege may make changes to the materials at any time without notice and does not make any commitment to update them.
Links
ESLeCollege has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by ESLeCollege. Use of any linked website is at the user's own risk.
Modifications
ESLeCollege may revise these Terms and Conditions at any time without notice. By using this website you are agreeing to be bound by the then-current version of these terms.
Governing Law Updated
These Terms and Conditions are governed by and construed in accordance with the laws of Thailand, including the Personal Data Protection Act B.E. 2562 (PDPA). Where applicable, ESLeCollege also complies with the requirements of the EU General Data Protection Regulation (GDPR) and the UK GDPR as they relate to the processing of personal data.
By using and/or downloading learning materials on our site, you confirm that you have read and accepted these Terms and Conditions and agree to abide by them.
